General Terms and Conditions (GTC)

of CASA MiRo GmbH

1. Scope of Application & Contracting Parties

These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the temporary rental of apartments and flats for accommodation purposes concluded between CASA MIRO GmbH (hereinafter “CASA MIRO”) and third parties (hereinafter “Guest”), as well as to all additional services and deliveries provided by CASA MIRO.

General terms and conditions of the Guest shall only apply if expressly agreed in writing in advance.

2. Reservations / Booking

By making a reservation/booking, the Guest submits an offer to conclude an accommodation contract. Subject to availability of the booked apartment, CASA MIRO will provide the Guest with a reservation/booking confirmation. Upon such confirmation, an accommodation contract is concluded between CASA MIRO and the Guest.

Offers made by CASA MIRO regarding available apartments are non-binding and subject to change. CASA MIRO reserves the right to refuse the conclusion of an accommodation contract at its sole discretion.

If the Guest books only a category within an offered property, the Guest has no entitlement to accommodation in a specific apartment/unit. CASA MIRO reserves the right to apply customary industry restrictions such as minimum stays, booking guarantees, or advance payments for certain travel dates.

3. Cancellation Periods / Withdrawal by the Guest / Non-Use of Services (No-Show)

A reservation is only considered guaranteed once payment has been received by CASA MIRO. The Guest may cancel the reservation free of charge within the specified cancellation period in accordance with the applicable cancellation conditions, stating the relevant reservation number.

If no right of withdrawal has been agreed or such right has expired (end of the free cancellation period), there is no statutory right of withdrawal or termination. If CASA MIRO does not agree to terminate the contract, CASA MIRO retains the right to the agreed remuneration despite non-utilization of the service (no-show) or late cancellation.

CASA MIRO shall credit any income generated from re-letting the apartment as well as any expenses saved. If the apartment is not re-let, CASA MIRO may apply a lump-sum deduction for saved expenses. In such case, the Guest is obliged to pay 90% of the contractually agreed accommodation price.

The Guest is entitled to prove that CASA MIRO has incurred no damage or a lesser amount of damage.

In the event of non-arrival for multi-night guaranteed reservations, all subsequent nights from the first night onward will be cancelled, and the Guest shall have no claim to the remaining nights.

For reservations made on the day of arrival, the Guest must make payment pursuant to Section 5 immediately, generally within one hour.

4. Accommodation Prices & Other Charges

The prices displayed by CASA MIRO at the time of contract conclusion shall apply.

All stated prices are gross prices and include all statutory taxes, fees, and charges.

Local charges payable by the Guest, such as tourist taxes, are not included.

5. Payment Terms & Invoice

The price for the booked accommodation service must always be paid by the Guest in advance.

Set-off by the Guest is excluded unless the counterclaim is undisputed or legally established.

Accepted means of payment are MasterCard, Visa, American Express, Sofortüberweisung/Klarna, PayPal, or standard bank transfer.

Cash payments are not accepted.

CASA MIRO reserves the right to charge the stored payment method for additional services used or for violations of these GTC. The Guest expressly authorizes CASA MIRO to do so.

By making a reservation, the Guest agrees to receive the invoice via download or by email.

6. Use of Reserved Apartments

A reserved apartment is available to the Guest for the period specified in the booking.

Keys, parking permits, and/or key cards provided by CASA MIRO must be returned on the day of departure to CASA MIRO, a third party designated by CASA MIRO, or left at the drop-off location indicated by signage and/or message within the apartment.

In the event of loss or non-return of a key, key card, or parking permit, a fee of EUR 40.00 will be charged. CASA MIRO is further entitled to claim additional compensation if the damage exceeds EUR 40.00, including replacement of the locking system if required for security reasons. The Guest may prove that no or lesser damage occurred.

A later departure (late check-out) than the standard check-out time of 3:00 p.m. may be agreed upon request and subject to availability.

If CASA MIRO agrees to a late check-out, CASA MIRO may charge EUR 10.00 per commenced hour. If no agreement exists, CASA MIRO is entitled to charge EUR 30.00 per commenced hour.

If departure occurs more than three hours after the agreed check-out time with CASA MIRO’s consent, the full nightly rate will be charged. Without consent, the Guest owes the full nightly rate plus any additional damages incurred. The Guest may prove that no or lesser damage occurred.

The Guest has no contractual entitlement to a late check-out.

An earlier arrival (early check-in) than the standard check-in time of 10:00 a.m. may be agreed upon upon request and subject to availability.

If CASA MIRO agrees, a fee of EUR 10.00 per commenced hour may be charged. The Guest has no contractual entitlement to early check-in.

7. Transfer, Subletting, and Use

Subletting, re-renting, or brokering of the booked apartment is prohibited. This includes in particular offering apartments or apartment contingents to third parties at prices higher than those published by CASA MIRO.

Assignment or sale of claims against CASA MIRO is also prohibited.

In such cases, CASA MIRO is entitled to cancel the reservation, especially if the Guest has provided false information to third parties regarding the booking or payment.

Use of CASA MIRO apartments for purposes other than accommodation is strictly prohibited, in particular commercial or illegal use.

Use for photo or video recordings is also prohibited without explicit consent. CASA MIRO reserves the right to cancel the reservation without refund and to vacate the apartment if used for non-accommodation purposes.

8. Liability of CASA MIRO

CASA MIRO is liable without limitation for damages resulting from injury to life, body, or health for which CASA MIRO is responsible, as well as for damages caused by intentional or grossly negligent breach of duty.

In cases of slight negligence, CASA MIRO is liable only for foreseeable damages typical for the contract, provided a cardinal obligation is breached.

Breaches by legal representatives, employees, or vicarious agents are attributed to CASA MIRO.

Any further claims for damages are excluded unless otherwise regulated in these GTC.

In the event of disruptions or defects, CASA MIRO will endeavor to remedy them upon immediate notice by the Guest or upon becoming aware.

The Guest is obliged to reasonably assist in remedying the issue and minimizing damage and must immediately inform CASA MIRO of the possibility of significant damage.

CASA MIRO is liable for property brought in by the Guest in accordance with statutory provisions. Claims expire if not reported immediately after becoming aware of loss, destruction, or damage, unless late notification does not affect clarification.

For cash, valuables, or items exceeding EUR 800.00, or other items exceeding EUR 3,500.00, a separate written agreement is required; otherwise, liability is excluded.

No safekeeping contract exists for parking spaces provided free of charge or for a fee. CASA MIRO has no monitoring obligation.

CASA MIRO is liable for loss, theft, or damage to vehicles only in cases of intent or gross negligence.

The Guest must report damages immediately. CASA MIRO is not liable for damages caused solely by other guests or third parties.

Claims against CASA MIRO generally become time-barred after one year, except for claims involving injury to life, body, or health, gross negligence, intent, or breach of a cardinal obligation.

CASA MIRO assumes no liability for lost property except in cases of intent or gross negligence. Lost items are returned only upon request, against reimbursement of shipping costs and a EUR 15.00 handling fee, and are stored for six months before disposal.

9. Security Deposit

To secure claims arising from the accommodation contract, CASA MIRO may require a security deposit.

For stays of less than three months: EUR 250.00.

For stays of three to six months: one monthly accommodation rate.

For stays under three months, CASA MIRO may secure the deposit via pre-authorization of the payment method.

If the deposit is not provided, the Guest has no right to the stay. CASA MIRO may terminate the contract without notice if the deposit is not paid within a reasonable grace period.

CASA MIRO shall settle the deposit within one month after the end of the accommodation contract.

10. Customer Data

CASA MIRO collects email addresses and phone numbers to ensure communication and may request a valid identification document digitally at check-in.

Domestic guests: ID card or passport; foreign guests: passport.

If identity cannot be clearly verified due to missing or incorrect documents, CASA MIRO may cancel the booking.

CASA MIRO uses fraud prevention software that generates a fraud-prevention score based on Guest data. CASA MIRO reserves the right to cancel bookings flagged by the system.

11. Termination of the Accommodation Contract

CASA MIRO is entitled to terminate the contract for good cause, particularly if:

a) force majeure or other circumstances beyond CASA MIRO’s control make performance impossible;

b) use of services may endanger operations, safety, or reputation;

c) bookings are made with misleading or false information;

d) the purpose of stay is illegal or involves prostitution;

e) prohibited resale or subletting occurs (see Section 7).

CASA MIRO shall inform the Guest immediately.

No claim for damages exists in case of justified termination.

CASA MIRO may also cancel or refuse future bookings by the Guest.

12. Vouchers

Vouchers purchased from CASA MIRO may only be redeemed for CASA MIRO services. Remaining balances remain valid. Vouchers are non-refundable, non-transferable, and not redeemable for cash. The purchaser is responsible for correct recipient details.

13. Smoking Ban

All apartments are non-smoking. Smoking, including e-cigarettes, shishas, and similar devices, is strictly prohibited.

Balcony/terrace smoking is permitted only if expressly designated and with doors closed.

Violations result in compensation of at least EUR 250.00.

Tampering with fire exits, extinguishers, alarms, or safety/noise sensors is prohibited and subject to a EUR 150.00 penalty.

CASA MIRO may terminate bookings immediately without refund.

Guests are fully liable for costs resulting from false fire alarm activation.

14. Prohibition of Parties and Gatherings

Noise must be avoided. Quiet hours are 10:00 p.m. to 6:00 a.m. Parties and gatherings are strictly prohibited.

Violations incur damages of EUR 500.00 minimum.

Noise sensors and video surveillance may be installed in common areas.

CASA MIRO may terminate bookings immediately and charge third-party intervention costs.

15. Damage or Unauthorized Removal of Inventory

The Guest is liable for damages exceeding normal wear and tear or unauthorized removal of inventory, including lost revenue, legal costs, and a EUR 50.00 handling fee.

16. Pets

Pets are not permitted, except certified service animals with prior proof.

Unauthorized pets incur a EUR 150.00 cleaning fee and may lead to immediate termination without refund.

17. Maintenance

The Guest must treat the apartment with care and may be charged at least EUR 80.00 for excessive soiling.

Defects must be reported immediately.

The Guest is liable for damages caused by misuse.

For stays over 7 nights, CASA MIRO may perform weekly interim cleaning.

18. Internet Use

Internet access is provided subject to availability.

Misuse, including illegal downloads or content, is prohibited. The Guest indemnifies CASA MIRO against third-party claims.

Sharing access credentials is prohibited.

CASA MIRO may block access in case of violations.

20. Final Provisions

Amendments must be in text form.

Place of performance and payment is the registered office of CASA MIRO.

Exclusive place of jurisdiction is the registered office of CASA MIRO.

German law applies; UN sales law is excluded.

Invalid provisions do not affect the validity of remaining provisions.

CASA MIRO is neither willing nor obliged to participate in consumer dispute resolution proceedings.
